CT-187: Election or Revocation of Election By Railroad and Trucking Corporations To Be Taxable Under Article 9 (Revision 2016-12)

New York · NY DTF · Used for tax years 2024

Form CT-187 lets railroad and trucking corporations elect to be taxed under New York Tax Law Article 9, sections 183 and 184, or revoke a previous election. The election remains in effect until revoked, and revocation is permanent and makes the corporation subject to Article 9-A.

Who files this form

Railroad and trucking corporations use Form CT-187 to elect taxation under Article 9, sections 183 and 184, or to revoke a previous election. These corporations are otherwise subject to tax under Article 9-A.

The form's definition includes corporations, joint-stock companies, limited liability companies, publicly traded partnerships taxed as corporations under the Internal Revenue Code, and associations formed for or principally engaged in railroad, palace car, sleeping car, or trucking businesses, or a combination of those businesses.

When it's due

For the 2024 tax year, the form gives these timing rules:

  • Election: File no later than the due date, without extensions, of the first return that would be due under Article 9, section 183 or 184, or Article 9-A. The text does not give a calendar date for this deadline.
  • Revocation: File by April 15 of the first year the corporation is not to be taxed under Article 9. If April 15 falls on a Saturday, Sunday, or legal holiday, the deadline is the next business day.
  • Effective date of revocation: A timely revocation takes effect January 1 of that year. A late revocation takes effect the following January 1.

Common mistakes

  • Counting on an extension for the election: The election deadline is based on the first return's due date without extensions.
  • Filing a revocation late and expecting it to apply that year: A late revocation takes effect the following January 1.
  • Assuming a revocation can be reversed: Revocation is permanent. Once revoked, the corporation cannot later elect again to be taxed under Article 9, sections 183 and 184.
