EOTC-PIT: Economic Opportunity Credit Claims Against Personal Income Tax (Revision 2022-08)

West Virginia · WV Tax Division · Used for tax years 2026

West Virginia Schedule EOTC-PIT calculates the Economic Opportunity Credit claimed against personal income tax through a pass-through entity. It reports the entity’s available credit, your ownership share and income, and the credit applied to your personal income tax.

Who files this form

Personal Income Tax taxpayers claiming an Economic Opportunity Credit from a pass-through entity must complete Schedule EOTC-PIT and file it with their West Virginia Personal Income Tax return, Form IT-140.

Each shareholder or partner is allocated the available credit based on their percentage of ownership in the pass-through entity.

What you'll need

Have these forms and records available:

  • Form IT-140, your West Virginia Personal Income Tax return.
  • Form EOTC-1 or EOTC-HTM, completed by the pass-through entity providing the credit. Attach a copy to Schedule EOTC-PIT.
  • Federal Form 1120S, Schedule K-1, showing your ownership percentage and ordinary income from the entity. Attach a copy showing your ownership percentage.
  • Form PTE-100, for the entity’s West Virginia apportionment factor.
  • The entity’s name, FEIN and tax year ending date.

If you claim credit from more than one pass-through entity, attach the required documents for each entity. Nonresident and part-year calculations also use information from Form IT-140NR/PY.

How to file

  1. Complete Part I using the pass-through entity’s information and credit calculations.
  2. Complete Part II to calculate the credit you can apply against Personal Income Tax.
  3. Transfer the amount from Part II, line 14 to the appropriate line on your Personal Income Tax return.
  4. File Schedule EOTC-PIT with Form IT-140, attaching the required EOTC-1 or EOTC-HTM and Federal Schedule K-1 copies.
  5. Give a copy of your completed Schedule EOTC-PIT to the pass-through entity through which you claim the credit.

The supplied text does not specify a mailing address for filing or an e-file procedure.

Common mistakes

  • Missing attachments: Include the required EOTC-1 or EOTC-HTM and Federal Schedule K-1 copies for each entity from which you claim credit.
  • Not giving the entity a copy: You must provide your completed schedule to the pass-through entity through which the credit is claimed.
  • Incorrect decimal entries: Enter the apportionment factor, project payroll factor, ownership percentage and qualified income fraction to six decimal places. The qualified income fraction cannot exceed 1.0.
  • Ignoring EOTC-HTM directions: Leave Part I, lines 4 and 7 and Part II, line 4 blank. Enter 1.00 on Part II, line 12, and use line 13 as the amount on line 14.
  • Using an unsupported offset factor: Unless using EOTC-HTM, enter 0.80 on Part II, line 12 unless the new jobs’ median salary is higher than the statewide average nonfarm payroll wage. A 1.00 entry must be supported by the attached EOTC-1 filed by the entity.
