770IP: Virginia Fiduciary and Unified Nonresident Automatic Extension Payment (2024)
Virginia · Virginia Tax · Used for tax years 2024
Virginia Form 770IP is an automatic extension payment voucher and worksheet for fiduciary taxpayers and pass-through entities filing unified nonresident returns on Form 770 or Form 765. It calculates tentative tax due after payments and credits and records the amount paid. The fi
Who files this form
Form 770IP is for fiduciary taxpayers and pass-through entities filing for unified nonresident taxpayers who will file Form 770 or Form 765.
Use it if both apply:
- You cannot file your return by the due date.
- You owe additional tax, as calculated on the Tentative Tax Computation Worksheet.
Do not file the paper voucher if no payment is due or if you pay electronically. You do not need to file Form 770IP just to receive the automatic 6-month filing extension.
For an individual income tax extension payment, use Form 760IP instead.
When it's due
For tax year 2024:
- Payment deadline: The 2024 Form 770IP must be postmarked by May 1, 2025, with payment, to avoid interest and penalties.
- Extended filing date: For calendar-year filers, the form lists November 1 as the automatically extended filing date.
- Fiscal-year filers: File Form 770IP and pay the balance due on or before your return's due date.
If the due date falls on a Saturday, Sunday, or legal holiday, you may file the voucher with payment on the next day that is not a Saturday, Sunday, or legal holiday.
The extension gives you more time to file, not more time to pay. You must pay at least 90% of your tax liability by the original due date to avoid the extension penalty.
What you'll need
Have these items and details ready:
- The income tax return you will file for the taxable year, to help calculate your tentative tax.
- Your expected total Virginia income tax.
- Amounts for Virginia income tax withheld, estimated tax payments, and any overpayment credit from the previous taxable year.
- The name and FEIN of the estate, trust, or unified nonresident taxpayer.
- The fiduciary's or unified nonresident representative's name, title, and address, plus a daytime phone number.
- Your fiscal year's beginning and ending dates, if applicable.
- A check or money order if paying by mail.
Keep the completed Tentative Tax Computation Worksheet with your tax records.
How to file
Calculate the payment
- Complete the Tentative Tax Computation Worksheet using the return you will file for the taxable year.
- Add your withholding, estimated payments, and previous-year overpayment credit.
- Subtract that total from your expected Virginia income tax.
- Transfer the balance on Line 4 to the voucher's Payment Amount box.
Pay online
Make your payment at www.tax.virginia.gov using eForms or Web Upload. Do not file the paper Form 770IP if you pay electronically.
Pass-through entities must make all unified nonresident income tax payments electronically if any payment exceeds $1,500 or total payments are expected to exceed $6,000. This includes estimated, extension, and return payments.
Pay by mail
Complete the voucher, detach it, and include your check or money order. Write your FEIN, taxable year, and “VA 770IP” on the payment.
Mail it to:
Department of Taxation
P.O. Box 1478
Richmond, VA 23218-1478
If you are a fiscal-year filer, check the Fiscal Year Filer box and enter your beginning and ending dates. Keep the worksheet with your tax records.
Common mistakes
- Treating the filing extension as a payment extension. Payment is still due by the original deadline, and late payments accrue penalties and interest.
- Sending a voucher when no payment is due or when paying electronically. The form says not to file Form 770IP in either case.
- Using this form for an individual income tax extension payment. Use Form 760IP instead.
- Mailing the voucher without payment. Be sure to include your payment.
- Leaving identifying details off the payment. Write your FEIN, taxable year, and “VA 770IP” on it.
- Ignoring the electronic-payment requirement. Pass-through entities must pay electronically when the stated payment thresholds apply.
Questions people ask
Do I need Form 770IP to get an extension?
No. Virginia automatically grants a 6-month extension to file fiduciary and unified nonresident returns. Form 770IP is a payment voucher, not an extension request.
Does the extension give me more time to pay?
No. You must pay tentative tax by the original payment deadline. Penalties and interest apply to late payments.
What if the worksheet shows no additional tax due?
Do not file Form 770IP if you do not owe additional tax.
Do I mail the voucher after paying online?
No. The form says not to file Form 770IP if you make the payment electronically.
What happens if I pay less than 90% by the due date?
If you file within the 6-month extension period but fail to meet the 90% payment requirement, the balance due with your return is subject to an extension penalty of 2% per month, from the due date through the filing date, up to 12%.
