770ES: Virginia Estimated Payment Vouchers for Estates, Trusts and Unified Nonresidents (2024)

Virginia · Virginia Tax · Used for tax years 2024

Virginia Form 770ES provides vouchers and instructions for making estimated income tax payments for estates, trusts, and pass-through entities filing unified returns for nonresident owners. Each voucher identifies the estate, trust, or entity and the payment amount.

Who files this form

Form 770ES is used to make estimated Virginia income tax payments for estates, trusts, and pass-through entities filing a unified return for nonresident owners.

You must make estimated payments if your expected Virginia income tax liability, after allowable credits, is more than $150. For an estate, this requirement applies only if the 2024 taxable year ends two or more years after the decedent’s death.

You do not have to file Form 770ES if your expected Virginia income tax for 2024 is $150 or less. An estate also does not have to file if its 2024 taxable year ends less than two years after the decedent’s death.

When it's due

For tax year 2024 calendar-year filers, the printed payment deadlines are:

  • Voucher 1: May 1, 2024.
  • Voucher 2: June 15, 2024.
  • Voucher 3: September 15, 2024.
  • Voucher 4: January 15, 2025.

You may pay the full estimate by May 1, 2024, or pay in equal installments. If you first meet the filing requirements later in 2024, use the payment schedule to determine your first voucher and the number of payments required.

If a deadline falls on a Saturday, Sunday, or legal holiday, the text allows filing and payment on the next business day without penalty or interest.

For fiscal-year filers, the printed schedule uses the 15th day of the 4th, 6th, and 9th months, and the 15th day of the 1st month of the next taxable year. Enter your fiscal year’s beginning month on the voucher.

Qualifying farmers, fishermen, and merchant seamen need only file Voucher 4 by January 15, 2025, for the 2024 estimated-payment schedule.

What you'll need

Have these forms and details ready:

  • The 2024 Estimated Income Tax Worksheet and the appropriate Form 770ES voucher.
  • Expected taxable income, Virginia modifications, and tax credits needed to complete the worksheet.
  • The estate’s, trust’s, or pass-through entity’s Federal Employer Identification Number (FEIN).
  • The entity’s name, the fiduciary’s or entity representative’s name and title, mailing address, and daytime phone number.
  • Your fiscal year’s beginning month, if you file on a fiscal-year basis.
  • A check or money order for the installment amount if submitting a paper voucher and payment.

The included payment record has spaces for payment dates, check or money order numbers, amounts paid, and overpayment credits applied.

How to file

Complete the Estimated Income Tax Worksheet, then use the payment schedule to choose the correct voucher and installment amount.

Electronic payments: Virginia offers eForms and Web Upload through www.tax.virginia.gov. Payments use Debit EFT and may be scheduled for a future date. You may also make an ACH Credit payment through your bank, which may charge a fee.

Pass-through entities must submit all unified nonresident income tax payments electronically if any payment exceeds $1,500 or total payments are expected to exceed $6,000. This includes estimated, extension, and return payments.

Mail: The mailing instructions say that, if you have been granted a waiver, send your voucher and payment to:

Virginia Department of Taxation

P.O. Box 1478

Richmond, VA 23218-1478

You may instead use the listed local filing address for the Virginia city or county where the fiduciary qualified. If there was no qualification in Virginia, the first voucher is filed where the fiduciary resides, does business, or has an office, or where a beneficiary resides.

For local filing, use the Commissioner of the Revenue column for the first voucher and the Treasurer column for later vouchers. Later vouchers may also be sent directly to the Department of Taxation.

Make checks payable to the Department of Taxation when filing with the Department, or to your local Treasurer when filing locally.

Common mistakes

  • Using a Social Security Number instead of a FEIN. Use the entity’s FEIN, not the decedent’s Social Security Number. If the FEIN has not been received, enter “Applied for.”
  • Missing required estimated payments. The text warns that failing to make required payments may result in an additional charge for underpayment.
  • Leaving payments unchanged when your estimate changes. Recompute your estimated tax if your expected Virginia tax liability changes, then adjust the next payment.
  • Mailing a return to a help or forms-request address. The text specifically says not to mail income tax returns to P.O. Box 1115 or P.O. Box 1317.
  • Overlooking voucher checkboxes. Check the applicable box if your address is new or this is your first payment for the taxable year.

It is used to make estimated Virginia income tax payments for estates, trusts, and pass-through entities filing unified nonresident returns.

What if I do not have a FEIN?

Yes. The Department’s eForms and Web Upload options allow Debit EFT payments to be scheduled for a future date.
