When it's due
For tax year 2025, calendar-year returns are due May 1, 2026.
What you'll need
Have the following information and documents ready, as applicable:
- The estate or trust’s federal return, including federal taxable income, exemption, and distribution information.
- The estate or trust’s name and FEIN, plus the fiduciary’s name, title, and address.
- Records of Virginia income tax withheld, 2025 estimated tax payments, any overpayment credit from 2024, and extension payments made with Form 770IP.
- Beneficiary names, addresses, SSNs or FEINs, and distribution information for Schedule 5.
- Virginia-source income and related federal deductions for a nonresident estate or trust.
The form specifically asks you to attach or enclose:
- Withholding statements when reporting Virginia income tax withheld.
- A copy of the other state’s return when claiming credit for tax paid to that state.
- Form 760C or Form 760F when entering an amount from either form on Line 8.
- Explanations for other additions or other subtractions reported on Schedule 3.
Common mistakes
- Overlooking attachment reminders. Attach withholding statements and enclose the other state’s return when claiming the corresponding withholding or credit. If reporting an amount from Form 760C or Form 760F, enclose that form and check the box on Line 8.
- Claiming credits beyond the printed restriction. Only carryover credit is allowed for the Enterprise Zone Act Tax Credit and the Barge and Rail Usage Tax Credit.
- Leaving out explanations. Schedule 3 asks for an explanation of other additions and other subtractions.
- Assuming nonresident beneficiaries have no Virginia tax obligation. The Schedule 5 notice says Virginia-source income is subject to Virginia taxation regardless of residency or domicile, and recipients may need to file a Virginia return.
