TC-41: Utah Fiduciary Income Tax Return (2024)

Utah · Utah Tax Commission · Used for tax years 2024

Form TC-41 is Utah’s 2024 Fiduciary Income Tax Return for estates and trusts. It reports income, deductions, credits, withholding and payments to calculate Utah tax due or a refund.

What you'll need

Have these forms and details available, as applicable:

  • Federal return: Form 1041 or 1041-QFT for federal total income. TC-41 also uses deduction amounts from Form 1041. The bankruptcy estate schedule uses information from Form 1040 and its schedules.
  • Identification: The estate or trust’s name and EIN or SSN, plus the fiduciary’s name, address, and EIN or SSN.
  • Income adjustments and credits: TC-41A for additions, subtractions, and credits, plus the worksheet for the estate or trust credit deduction amount.
  • Residency schedules: TC-41B for nonresident or part-year resident estates or trusts. Bankruptcy estates use TC-41C; nonresident or part-year resident bankruptcy estates must also complete its second page.
  • Withholding records: W-2s or 1099s showing Utah withholding, used to complete TC-41W. Do not attach the W-2s or 1099s to the Utah return.
  • Prepayment information: TC-548 and the amount of any 2023 refund applied to 2024.
  • Beneficiary information: Names, addresses, tax identification numbers, income shares, credits, and withholding details for the applicable beneficiary schedules.
  • Tax paid to another state: TC-41S if claiming that credit.

Common mistakes

  • Sending W-2s or 1099s with the return. Instead, enter their information on TC-41W, and only if they show Utah withholding.
  • Including income adjustments that do not belong at the trust level. TC-41 lines 5 and 12 say to include only amounts taxed at the trust level or applying to income taxed there.
  • Skipping the residency schedule. Nonresident or part-year resident estates or trusts must complete TC-41B before continuing to line 26. Nonresident or part-year resident bankruptcy estates must also complete TC-41C, page 2.
  • Treating an extension as extra time to pay pass-through withholding. The note on line 31 says this amount must be paid by the return’s due date, without extensions.
  • Claiming the other-state tax credit as a nonresident. TC-41S says nonresident estates and trusts do not qualify, and part-year residents rarely qualify.
  • Submitting blank supplemental pages. Pages marked “Submit page ONLY if data entered” should be submitted only when completed and attached to the return.
