538-S: 2025 Form 538-S Claim for Credit Refund of Sales Tax (2025)
Oklahoma · Oklahoma Tax Commission · Used for tax years 2025
Oklahoma Form 538-S is used to claim a credit or refund of sales tax for 2025. It reports household income, dependent information, and qualified exemptions to calculate the credit.
Who files this form
Form 538-S is used to claim Oklahoma's sales tax credit or refund for tax year 2025.
You must have been legally domiciled in Oklahoma for the entire year and meet either of these income tests:
- Total gross household income was $20,000 or less.
- Total gross household income was $50,000 or less, and you can claim a dependent exemption, you or your spouse were age 65 or older by December 31, 2025, or you have a physical disability constituting a handicap to employment. Proof of disability is required.
You do not qualify if you received Temporary Assistance for Needy Families (TANF) for any month in 2025, live in Oklahoma under a visa, or were convicted of a felony and were in Department of Corrections custody for any part of the year. A taxpayer or spouse who died during the tax year does not qualify for their credit.
The Department of Human Services will make sales tax refunds to people who continuously received aid to the aged, blind, disabled, or Medicaid payment for nursing home care from January 1, 2025 through December 31, 2025.
When it's due
For tax year 2025, the form lists these deadlines:
- April 15: File your return claiming the credit if you are required to file an Oklahoma income tax return.
- June 30: File Form 538-S if you are not required to file an Oklahoma income tax return.
The form also references an April 20 due date for electronically filed returns in its extension note. If you have an income tax filing extension, file Form 538-S with your income tax return by the extended due date and provide a copy of the extension.
A later due date provided by the Internal Revenue Code applies. If the due date falls on a weekend or legal holiday when Oklahoma Tax Commission offices are closed, the deadline moves to the next business day.
An amended return cannot be used to claim this credit after the due date, including extensions.
What you'll need
Have these details and supporting documents ready:
- Taxpayer and spouse names, Social Security numbers, mailing address, and 2025 physical address if different.
- Each dependent's name, Social Security number, age, relationship, and yearly income. If you have more than four dependents, include a statement with this information for the additional dependents.
- Information about taxable and nontaxable income and assistance received by everyone in your household during 2025, including nontaxable income shown on W-2s.
- Your federal return, including schedules, if reporting income on line 11 from rentals, royalties, partnerships, estates, trusts, or property gains, or on line 12 from a business or farm.
- Proof of disability if claiming eligibility on that basis. Accepted proof includes certification from a state agency, insurance company, or physician; eligibility for federal Social Security disability benefits; or U.S. Department of Veterans Affairs certification of a service-connected disability.
- A copy of your filing extension, if applicable.
- Account and routing numbers if requesting direct deposit.
How to file
Complete the taxpayer, exemption, dependent, and household income sections. Add income lines 1 through 13 to get total gross household income on line 14. If you qualify, multiply the total qualified exemptions in Box D by $40 and enter the credit on line 15. Sign the form.
If you file Form 511: Claim the credit on Form 511, line 25, and provide the signed Form 538-S. This also applies if you are not required to file an income tax return but file Form 511 to recover withholding or estimated payments. Make your direct deposit selection on Form 511.
If you are not filing an income tax return: Mail the completed and signed Form 538-S to:
Oklahoma Tax Commission
PO Box 26800
Oklahoma City, OK 73126-0800
If you are not filing Form 511, use Form 538-S to select direct deposit, a debit card, or a paper check. A paper check requires a refund of at least $10. If you select no option, you will receive a debit card.
Common mistakes
- Leaving the form incomplete: The form warns that missing information may delay your refund.
- Entering negative amounts or cents: Negative amounts are not allowed. Round amounts under 50 cents down and amounts from 50 to 99 cents up to the next whole dollar.
- Leaving out household income: Include taxable and nontaxable gross income and assistance received by all household members. Do not include income deferred for federal income tax purposes, such as tax-deductible contributions to a 401(k) or traditional IRA, until distributed and taxed on your federal return.
- Listing yourself or your spouse as a dependent: The form specifically says not to do this.
- Using incorrect bank details: Verify your routing and account numbers. If direct deposit fails, you will receive a debit card.
- Requesting direct deposit through a foreign financial institution: The Oklahoma Tax Commission does not allow this and will issue a paper check instead.
- Waiting to claim the credit on a late amended return: The claim must be filed by the due date, including extensions.
Questions people ask
How much is the credit?
For a qualifying household, the credit is $40 multiplied by the total qualified exemptions entered in Box D. No credit is allowed if household income exceeds the applicable limit.
Whose income counts toward the household income limit?
Income received by everyone living in the same household counts, whether taxable or not. Examples include child support, public assistance, workers' compensation, school grants or scholarships, veterans disability compensation, and the income types listed on the form.
Can I claim a dependent for this credit?
The dependent must qualify and be claimed as a dependent for federal income tax purposes. They must also meet the other sales tax credit requirements, including Oklahoma residency for the entire year. Enter their name, Social Security number, age, relationship, and yearly income, if any.
What happens if a taxpayer or spouse died?
A taxpayer or spouse who died during the tax year does not qualify for their sales tax credit. If the death occurred after December 31, 2025, but before the form was filed, the deceased person's credit or refund will be issued to their estate. Enter the date of death in the designated box.
Can I get a paper check instead of direct deposit?
If you are not filing Form 511, you may select a paper check on Form 538-S. A refund of at least $10 is required. If you request a paper check for less than $10, a debit card will be issued.
