513: 2024 Form 513 Oklahoma Resident Fiduciary Income Tax Return Packet & Instructions (2024)

Oklahoma · Oklahoma Tax Commission · Used for tax years 2024

Form 513 is the 2024 Oklahoma Resident Fiduciary Income Tax Return for resident trusts and estates. It reports taxable income and the adjustments used to determine Oklahoma taxable income. The packet includes the return, instructions, and fiduciary income tax table.

Who files this form

Every Oklahoma resident estate or trust must file a return for each taxable year. Only resident estates and trusts use Form 513. Nonresident estates and trusts use Form 513-NR.

  • A resident estate is the estate of someone who was domiciled in Oklahoma at death.
  • A resident trust is a trust created by a resident decedent’s will, by a resident during administration, or by a resident when the trust became irrevocable.
  • The fiduciary’s own residence does not determine the residence of the estate or trust.

A grantor trust must file an Oklahoma return if it must file federal Form 1041. Form 513 is also required when income is reported to Oklahoma under one entity identification number and the grantor files under a different identification number.

For an individual’s bankruptcy estate, the fiduciary must file Form 513 if the estate is required to file a federal income tax return. Form 513 serves as a transmittal for Form 511.

When it's due

  • 2024 calendar-year returns: Generally, the return must be postmarked by April 15, 2025.
  • Estates using a fiscal year beginning in 2024: The return must be postmarked by the 15th day of the fourth month following the close of the taxable year.

If a filing deadline falls on a day when Oklahoma Tax Commission offices are closed, filing by the end of the next business day is considered timely.

What you'll need

Have these records and attachments ready, as applicable:

  • Federal return and schedules: Use the exact figures from federal Form 1041 in Column A. Provide a copy of federal returns where applicable and all required schedules. Simple trusts must provide a complete Form 1041.

  • Oklahoma schedules: Schedules explaining differences between Columns A and B, and an Oklahoma Schedule K-1 for each beneficiary.
  • Refund information: Direct deposit information if you are receiving a refund.
  • Extension documentation: A copy of the federal extension if you rely on it to extend your Oklahoma filing deadline.

Common mistakes

  • Using the wrong tax-year packet: This packet is for a tax year beginning in 2024.
  • Leaving Part 2 incomplete: This may delay processing.
  • Omitting direct deposit information: Refunds must be made by direct deposit. Missing information delays refund processing.
  • Missing attachments: Provide applicable federal returns, required schedules, and schedules explaining differences between Columns A and B.
  • Incorrect FEINs, calculation errors, or missing signatures: Check the FEIN on every form and schedule, review calculations, and sign the return.
  • Putting beneficiary withholding on line 27: Do not include withholding paid on behalf of beneficiaries on this estimated-tax payment line. Withholding claimed at the fiduciary level belongs on line 29.
  • Omitting Form 569 for transferred or allocated credits: The affected credits will be denied.
  • Trying to change line 35 after processing: The amount applied to next year’s estimated tax cannot be changed once the original return has been processed. Line 35 is not valid on amended returns.

Questions people ask

Do trusts and estates need to make estimated tax payments?

Trusts must make quarterly estimated payments when the tax for the year can reasonably be expected to be $500 or more. Use Form OW-8-ESC. Estates are not required to make estimated tax payments.

Does a federal filing extension also extend the Oklahoma return?

Yes, if the federal extension is valid and no Oklahoma tax liability is owed. Attach a copy of the federal extension to the Oklahoma return. If the federal return is not extended or Oklahoma tax is owed, an Oklahoma filing extension can be requested on Form 504-C. At least 90% of the tax liability must be paid by the original due date to avoid late-payment penalties. Interest runs from the original due date.

How do I amend a Form 513 return?

Use Form 513, check the Amended Return box, and complete Schedule 513-X. Enter amounts previously paid on line 31 and previous refunds or applied overpayments on line 32. Provide the federal amended return and proof of IRS refund or payment, if available before the statute of limitations expires. Use the tax table for the year being amended.

How will the refund be paid?

Refunds must be made by direct deposit. Be sure to provide direct deposit information to avoid delaying the refund.
