Who files this form
Form 512-E is Oklahoma’s return for organizations exempt from income tax under Section 501(c) of the Internal Revenue Code. The form’s general instructions say every organization must file a return each year.
- All organizations must complete Part 1 and the signature section.
- Organizations with unrelated trade or business income must also complete Part 2.
Exempt organizations are subject to Oklahoma tax on unrelated business income.
What you'll need
Have the organization’s federal employer identification number (FEIN), address, and date it qualified for tax-exempt status ready.
Include these documents when they apply:
- Federal returns and schedules: A copy of any required annual IRS information return, such as Form 990, 990-EZ, or 990-PF, and its supporting schedules. If an IRS income tax return was required, include that return and supporting schedules, such as Form 990-T.
- Other taxable income: A schedule of any other taxable income.
- Deductions and credits: Form 561-C for the Oklahoma capital gain deduction and Form 511-CR for other tax credits.
- Oklahoma withholding: Form 1099, Form 500-A, Form 500-B, or another withholding statement.
- Amended returns: Schedule 512-E-X, necessary supporting schedules, and the amended federal return and proof of IRS disposition when applicable. For a federal audit, provide a complete copy of the RAR.
- Pass-through entity income exclusion: The required schedule identifying the electing entity and covered income or loss, plus the OTC acknowledgment letter. Provide Form 586 if the entity made a first-time election for the current tax year.
- Section 965(h) installment payments: A schedule of the tax computation.
For a direct-deposit refund, have the account type, routing number, and account number ready.

PO Box 26800

Pay the balance due in full with the return. Make checks payable to the Oklahoma Tax Commission.
Use a paper clip to attach documents. Do not staple them to the form.
For an amended return, mark the amended-return box on page 1 and complete Schedule 512-E-X on page 2.
Common mistakes
- Rounding too early: When adding amounts for a line, include cents in the calculation and round only the final total. Round amounts under 50 cents down and amounts from 50 to 99 cents up.
- Stapling attachments: The form says to use a paper clip instead.
- Using incorrect direct-deposit details: The routing number must have nine digits. Direct deposit will fail if its first two digits are not 01 through 12 or 21 through 32. Account numbers may have up to 17 characters; include hyphens but omit spaces and special symbols.
- Requesting direct deposit through a foreign financial institution: The OTC does not allow this and will issue a paper check instead.
- Expecting a deposit notice: The form says you will not receive notification of the deposit.
Questions people ask
What tax rate applies to unrelated business income?
The income tax rate is 4%. If the exempt organization is a trust, use the trust rate schedule on page 3 and enter “1” in the box on line 5.
Is investment income subject to Oklahoma income tax?
Investment income of exempt organizations that is subject to federal excise tax is not subject to Oklahoma income tax. However, income subject to income tax under the Internal Revenue Code is subject to Oklahoma income tax.
Can an overpayment be applied to next year’s estimated tax?
On an original 2025 return, line 14 allows an overpayment to be credited to 2026 estimated tax. An overpayment on an amended return must be refunded instead. The estimated-tax amount applied on the original return cannot be adjusted.
How will the organization receive its refund?
Refunds must generally be made by direct deposit. If the refund would go to or through a foreign financial institution, a paper check will be issued. If a financial institution refuses a direct deposit, a check will be sent to the address on the return.
