Schedule ND-1PG: Schedule ND-1PG - Planned Gift Tax Credit (2024)

North Dakota · ND Tax Commissioner · Used for tax years 2024

North Dakota Schedule ND-1PG calculates the planned gift tax credit for individuals and is attached to Form ND-1. It reports qualified planned gifts, available credit and carryovers, and any required adjustment to North Dakota taxable income.

Who files this form

Use Schedule ND-1PG to claim the planned gift tax credit as an individual who made a qualified planned gift to a qualified nonprofit organization or qualified endowment fund. You may also use the 2024 schedule to claim an allowable unused credit carried over from gifts made in 2021, 2022, or 2023.

A qualified planned gift must be an irrevocable charitable contribution made through one of the gifting methods listed in the schedule. Each method has its own eligibility requirements. The recipient organization or endowment fund must also meet the schedule’s requirements.

What you'll need

  • Required attachment: A letter from the qualified nonprofit organization stating its I.R.C. § 501(c) status, the planned gift method, the date and amount of the gift, and the name of the qualified endowment fund, if applicable.
  • Organization information: The nonprofit’s name and address, plus the name and address of any entity holding and administering the gift assets or endowment fund on its behalf.
  • Gift information: The gifting method, completion date, and portion of qualified gifts completed in 2024 for which a federal charitable contribution deduction is allowed in 2024.
  • Carryover information: Any allowable unused planned gift credit from gifts made in 2021 through 2023.
  • Federal return information, if completing lines 12 through 15: Your 2024 Form 1040 or 1040-SR and Schedule A information. The schedule refers you to the federal line 12 instructions to determine the standard deduction you would have been allowed.

Common mistakes

  • Completing new-gift lines for a carryover-only claim: If you are only carrying over unused credit from 2021, 2022, or 2023, skip lines 1 through 7 and start at line 8.
  • Leaving out the nonprofit letter: The schedule requires this attachment.
  • Overstating the credit used: Line 10 includes only the portion of available credit used to reduce your 2024 tax liability.
  • Carrying a 2021 gift credit into 2025: Line 11 allows carryovers to 2025 only for unused credits based on gifts made in 2022 through 2024.
  • Completing the adjustment lines after taking the standard deduction: Do not complete lines 12 through 15 if you claimed the standard deduction on your 2024 federal return.
  • Missing the special rule for endowment credits: If you itemized, have an amount on line 7, and also claim an endowment fund credit on Schedule ND-1QEC, line 5, or from a North Dakota Schedule K-1, do not complete lines 12 through 15. Instead, see the instructions for Form ND-1, line 2.

Questions people ask

How is the 2024 credit calculated?

Line 6 is the smaller of the eligible charitable contribution portion on line 4 or $50,000 if married filing jointly, or $25,000 otherwise. Multiply line 6 by 40% to calculate the 2024 credit on line 7.

Can I save unused credit for later years?

Yes. The credit must first be claimed in the tax year the planned gift is made. Unused credit for a gift made in 2024 may be carried forward for up to three tax years.

Which gifting methods are listed?

The schedule lists charitable remainder unitrusts, charitable remainder annuity trusts, pooled income fund trusts, charitable gift annuities, charitable lead unitrusts, charitable lead annuity trusts, deferred charitable gift annuities, charitable life estate agreements, and paid-up life insurance policies. Each must meet the eligibility criteria in the schedule.

What if I itemized but did not deduct this contribution?

Answer “No” on line 12 and stop there. No adjustment is required based on your 2024 contribution.
