Schedule 38-UT: Schedule 38-UT - Calculation of Interest on Underpayment or Late Payment of Estimated Income Tax (2025)

North Dakota · ND Tax Commissioner · Used for tax years 2025

North Dakota Schedule 38-UT calculates interest on underpaid or late estimated income tax payments for estates and trusts for 2025. It shows required quarterly payments, payments made, underpayments, and interest, and is attached to Form 38.

Who files this form

A fiduciary for an estate or trust may use Schedule 38-UT to check whether enough North Dakota estimated income tax was paid on time for 2025 and to calculate interest on an underpayment or late payment.

Do not complete or file this schedule if:

  • The estate or trust was not required to pay estimated federal income tax for 2025. See 2025 Federal Form 2210 to determine this.
  • The 2025 net tax liability minus 2025 withholding, figured on line 4, is less than $1,000.
  • The 2024 net tax liability entered on line 5 is less than $1,000. Enter zero if no return was required for 2024.

If a Part 1 exception applies, mark the applicable circle, complete Parts 2 and 3 as instructed, and attach Schedule 38-UT to Form 38.

When it's due

For the 2025 tax year, the schedule lists these estimated payment due dates for calendar-year filers:

  • 1st quarter: April 15, 2025.
  • 2nd quarter: June 15, 2025.
  • 3rd quarter: September 15, 2025.
  • 4th quarter: January 15, 2026.

The federal 4th quarter exception applies if the fiduciary did not have to make the January 15, 2026 federal estimated payment because the 2025 federal return was filed and the remaining federal tax was paid by February 1, 2026.

For 2025 estimated tax, interest runs from the payment due date until the earlier of April 15, 2026, or the date the estimated tax due is paid in full.

Fiscal-year filers should substitute corresponding dates.

What you'll need

Have these forms and payment details available:

  • 2025 Form 38, including the estate or trust name, FEIN, net tax liability on page 1, line 4, and withholding on page 1, line 8.
  • 2024 Form 38, if a return was required, for the prior-year net tax liability and any overpayment applied to 2025 estimated tax.
  • 2025 Federal Form 2210 to determine whether federal estimated tax payments were required.
  • Estimated tax payment amounts and dates, plus withholding amounts for each quarter.

Additional attachments may be needed:

  • For the federal annualized income installment method exception, attach the federal annualized income installment method worksheet from 2025 Federal Form 2210 and a worksheet showing the North Dakota calculations.
  • For the partial-year exception, attach a statement describing the situation.
  • If interest is computed separately, attach a worksheet showing that calculation.

How to file

Attach Schedule 38-UT to Form 38. Enter the total interest from Schedule 38-UT, line 17, on Form 38, line 17. Include any required exception statements or calculation worksheets.

Interest reduces any refund shown on Form 38. If Form 38 shows tax due, include the interest in the balance paid with the return.

If Form 38 shows neither an overpayment nor tax due, and Schedule 38-UT interest is $5.00 or more, include the interest in the balance due and submit a check or money order with the return.

Common mistakes

  • Starting without reading the instructions. The form specifically says to read them before completing the schedule.
  • Completing the schedule when it is not required. Check the federal estimated tax requirement and the less-than-$1,000 tests on lines 4 and 5 first.
  • Using the regular quarterly calculation when an exception applies. Read the line 7 instructions before completing the remaining columns.
  • Including withholding from nonresident beneficiaries on line 8. Do not include the amount from Form 38, page 1, line 5.
  • Working across all quarters at once. Complete lines 9 through 15 for one column before moving to the next. Lines marked “NA” do not apply.
  • Using calendar-year dates for a fiscal-year filer. The instructions say to substitute corresponding dates.

Questions people ask

What interest rate applies?

Interest is charged at 12% per year on an underpayment or late payment of estimated tax.

How is withholding divided among quarters?

Unless it can be shown otherwise, one-fourth of total withholding is treated as withheld by each payment due date.

Where do I enter a 2024 overpayment applied to 2025 estimated tax?

Enter it in the 1st quarter column on line 8. If a statement attached to the 2024 return requested that it be applied to another quarter, enter it in that quarter instead.

What changes if the qualified farmer exception applies?

Line 2 uses 66 2/3% instead of 90%. On line 7, enter the full amount from line 6 in the 4th quarter column and zero in the first three columns. This exception applies if the fiduciary qualified as a farmer for federal estimated tax purposes in 2025 and was required to make the federal estimated payment due January 15, 2026.
