Who files this form

Use Form IT-631 to claim the security officer training tax credit if you are subject to New York personal income tax under Article 22. The credit is for qualified building owners employing qualified security officers.

The form says you may qualify if you have received a certificate of tax credit from the New York State Division of Homeland Security and Emergency Services (DHSES) and are:

  • An individual, including a sole proprietor.
  • A fiduciary of an estate or trust.
  • A partner in a partnership, including a member of an LLC treated as a partnership for federal tax purposes.
  • A shareholder of a New York S corporation.
  • A beneficiary.

Partnerships also use IT-631 to report the credit. Taxpayers subject to tax under Article 9, 9-A, or 33 use Form CT-631 instead.

What you'll need

  • DHSES certificate of tax credit: If claiming an amount from a certificate, submit a copy with Form IT-631. You need the calendar year and credit amount shown on the certificate.
  • Taxpayer information: Enter your name as shown on your return and your taxpayer identification number.
  • Information about credits received from other entities: For Part 2, have each entity’s name, type, employer identification number, and your share of its credit.
  • Beneficiary information: For Part 3, have each beneficiary’s name as shown on Form IT-205, Schedule C, identifying number, and share of the credit.

How to file

File Form IT-631 with Form IT-201, IT-203, IT-204, or IT-205, as applicable.

Complete the parts that apply to you:

  • Individuals, sole proprietors, and partnerships: Complete Part 1, line A and lines 1 through 5.
  • Partners, New York S corporation shareholders, and estate or trust beneficiaries: Complete Part 1, lines 2 through 5, and Part 2.
  • Fiduciaries: Complete Part 1, line A and lines 1 through 5, and Part 3. If the estate or trust divides the credit with beneficiaries, submit all Forms IT-631 with Form IT-205 showing each beneficiary’s share.

For a credit shown on a DHSES certificate, enter the certificate’s calendar year on line A and its credit amount on line 1. Complete a separate Form IT-631 for each certificate and attach a copy of that certificate. Add the line 5 amounts from all Forms IT-631 when reporting the total on your return.

Report the credit:

  • Partnerships: Enter the line 5 amount and code 631 on Form IT-204, line 147.
  • Other filers: Enter the line 5 amount and code 631 on Form IT-201-ATT, line 12, or Form IT-203-ATT, line 12, or include the amount on Form IT-205, line 33.

Common mistakes

  • Leaving out an applicable part: The form specifically notes that if more than one filer category applies to you, complete all appropriate parts on one Form IT-631.
  • Combining certificates on one form: The line 1 instructions require a separate Form IT-631 for each certificate and a copy of the certificate with the form.
  • Missing the fiduciary calculation order: The line 3 reminder directs fiduciaries to enter that amount on the Total line of Part 3, column C, and complete Part 3 before finishing lines 4 and 5.

Questions people ask

How much is the credit?

The credit equals $3,000 multiplied by the number of qualified security officers protecting buildings owned by the taxpayer. DHSES allocates the amount allowed for the current tax year. Enter the amount shown on your certificate on line 1.

What if a security officer worked for only part of the year?

The credit is prorated to reflect the officer’s length of employment.

What happens if the credit is more than my tax?

The excess is treated as an overpayment that can be credited or refunded without interest.

How does an estate or trust divide the credit among beneficiaries?

Base the division on each beneficiary’s proportionate share of the estate’s or trust’s income. Provide beneficiaries with their proportionate credit amounts.

What if my spouse and I elected to file two federal Schedule C forms for our business?

If you made an IRC 761(f) election and file jointly, compute the credit as if you were filing one federal Schedule C for the business. Complete Part 1, line A and lines 1 through 5.
