New York · NY DTF · Used for tax years 2025
Form IT-2663 is New York’s estimated income tax payment form for nonresidents selling or transferring real property in 2025. It reports the sale or transfer, gain, and estimated tax due, or certifies a listed reason no estimated tax payment is required. It includes a gain-or-loss
Who files this form
Form IT-2663 is for nonresidents of New York State selling or transferring real property. It covers individual sellers and nonresident estates or trusts.
The form also provides a way to certify that no estimated tax payment is required because the sale results in a loss or because gain or loss does not have to be recognized under qualifying Internal Revenue Code provisions.
Do not use this form for a nonresident’s sale, transfer, or other disposition of shares in a cooperative housing corporation. Use Form IT-2664 instead.
When it's due
The 2025 tax year version applies to sales or transfers with a date of conveyance after December 31, 2024, but before January 1, 2026.
Submit the completed form and full estimated tax payment, if any, when the deed is presented to the county recording officer to be recorded.
What you'll need
Have the following information ready:
- The seller’s name, SSN or EIN, address, and mailing address if different. Include spouse or fiduciary information, if applicable.
- The property’s location and description, including county and tax map number, and the date of conveyance.
- Purchase price, improvements, closing costs, other basis adjustments, depreciation if applicable, sale price, and selling expenses for the worksheet.
- Installment agreement duration, if the gain is reported using the installment method.
Attach allocation statements when required for property partly outside New York, property partly qualifying as a principal residence, or multiple sellers. For multiple sellers, the statement must show each seller’s name, SSN or EIN, address, and share of the gain.
If claiming that gain or loss need not be recognized under the Internal Revenue Code, complete the summary with the applicable code sections and supporting facts.

Questions people ask
What tax rate does the 2025 form use?
The worksheet uses 10.90% (0.1090). Multiply the gain on line 18 by that rate and round the estimated tax to the nearest whole dollar.
What if the sale produces no gain or a loss?
If the worksheet result is zero or less, enter 0 on worksheet lines 17 and 20 and on the front page, line 2. Complete Part 2, Part 3, and Form IT-2663-V. Part 3, box A, requires the worksheet to be completed.
How do I report an installment sale?
Indicate that you are using the installment method and give the agreement’s duration. On worksheet line 18, enter the gain you and your spouse, if applicable, will report on your 2025 federal income tax return.
What if only part of the property qualifies as my principal residence?
Mark box C. On worksheet line 18, enter the gain allocated to the portion that did not qualify as your principal residence and will be reported on your 2025 federal return. Attach a statement showing how you calculated the allocation.
