- Category 1, emerging technology products or services: Qualify through the form’s receipts or sales test, or its expenditure test. Each test requires a percentage greater than 50%.
- Category 2, research and development (R&D): Have R&D activities in New York State and meet the applicable R&D funds percentage test. The form also provides a rule for companies with R&D funds but zero net sales.
If the company does not qualify under either category, the form says not to file the application.

Common mistakes
- Continuing after failing the initial eligibility questions: If the company is not located in New York State or its total annual product sales exceed $10,000,000, stop. It is not eligible for certification.
- Calculating the sales percentage when line 15 is zero: The form says to skip to line 18 instead.
- Missing the zero-net-sales rule: If the company has any R&D funds but zero net sales, skip to line 26 and mark Yes, as directed on line 24.
- Filing despite not qualifying: If the company fails Category 1 and answers No to either question 22 or 26 under Category 2, the form says not to file.
- Making a willfully false statement: The certification warns that a willfully false representation is a crime.
Questions people ask
Do all applicants need to complete Part 1?
Yes. Part 1, Business information, is required for all applicants.
Is exactly 50% enough to meet a Category 1 percentage test?
No. Both Category 1 percentage questions ask whether the percentage is greater than 50%.
What if the company has R&D funds but zero net sales?
Line 24 says that a company with any R&D funds but zero net sales is a QETC and should skip to line 26 and mark Yes. Category 2 also requires Yes on line 22, which asks whether the company has R&D activities in New York State.
What R&D percentage is required under Category 2?
Line 26 asks whether the R&D funds percentage equals or exceeds the applicable percentage for the certification period. The form refers to the instructions for that percentage, but no instructions were provided here.
What public disclosure does the application ask me to authorize?
Line 10 asks you to mark Yes or No to authorize public disclosure that the company is a certified QETC for the stated certification period, if it qualifies. The disclosure may include the legal name, trade name or DBA, physical address, and mailing address entered on lines 1 through 4.
