Who files this form

Form DTF-620 is an application for certification as a qualified emerging technology company (QETC).

To qualify, the company must be located in New York State and have total annual product sales of $10,000,000 or less. It must also qualify under one of these categories:

  • Category 1: Primary products or services. The company qualifies through emerging technology products or services that account for more than 50% of its total gross receipts or sales, or through expenditures for developing or creating those products or services that exceed 50% of total expenditures included on its federal return.
  • Category 2: Research and development (R&D) activities. The company must have R&D activities in New York State and meet the applicable R&D funds percentage for its certification period. The form refers to instructions for that percentage, but those instructions are not provided here. The form also provides a special rule for companies with R&D funds and zero net sales.

If the company does not qualify under either category, the form says not to file this application.

What you'll need

Have the following information ready to complete the application:

  • The beginning and ending dates of the certification period.
  • The company's legal name, trade name or DBA if different, New York business address, mailing address if different, and county.

  • Total annual product sales.
  • For the Category 1 sales test, a description of the emerging technology products or services and gross receipts or sales from those products or services and from all products or services.
  • For the Category 1 expenditure test, federal return figures for emerging technology development or creation expenditures and total expenditures.
  • For Category 2, R&D funds and net sales amounts.

An authorized person must sign and provide their title and the date.

Common mistakes

  • Continuing after failing the initial eligibility questions. If you answer No to either the New York location question or the $10,000,000-or-less annual product sales question, the form says to stop. The company is not eligible.
  • Filing without qualifying under either category. If the company fails Category 1 and answers No to either question 22 or 26 in Category 2, the form says not to file.
  • Making a false certification. The signature statement requires the application to be correct and complete to the best of the signer's knowledge and belief. It warns that a willfully false representation is a crime.
