New Mexico · New Mexico TRD · Used for tax years 2024, 2025, 2026

Form TRD-41416 is New Mexico's Federal Adjustment Report, submitted with an amended return to report adjustment details, the final determination date, and affected tax programs. It also includes a partnership payment election, a calculation of tax due, and a payment voucher.

Who files this form

TRD-41416 must be filed by any taxpayer, partner, or partnership that has completed a Federal Partnership Audit or Adjustment Request with a final determination date on or after January 1, 2021.

Submit this report with your amended return.

What you'll need

The form lists these required attachments:

  • A complete amended return.
  • A signed copy of the Federal Adjustment.
  • Copies of pages showing the changes explained in Section III.
  • A detailed report listing partners’ distributive shares. The form refers to instructions for details, but those instructions were not provided.

Have your taxpayer identification number, contact information, tax period, and final determination date available. For partnership reporting, Part IV requires the state partnership representative’s information and signature.

If you need a separate sheet to explain the adjustments, include your SSN, ITIN, or FEIN on it.

How to file

You can file this report online at New Mexico Taxpayer Access Point (TAP). The form requires you to submit it with your amended return.

Identify the affected tax programs and explain the changes in Section III. If you elect to pay under Section II, complete Section V on page 2 and attach all pages to your amended return.

Paying online

At TAP, under GENERAL TASKS, select Make a Payment, then Amended FAR. Electronic check payments have no charge. Credit card payments have a convenience fee.

Mailing a payment

Detach the AMD-FAR payment voucher at the dotted line and include it with your payment. Make your check or money order payable to New Mexico Taxation and Revenue Department. Mail the voucher and payment to:

New Mexico Taxation and Revenue Department

P.O. Box 8390

Santa Fe, NM 87504-8390

This address is printed for the payment voucher and payment, not as a mailing address for the report itself.

Common mistakes

  • Leaving out the amended return. The report must be submitted with it. If you complete the payment election, attach all pages.
  • Using an incorrect tax year or taxpayer identification number. Check these entries and make sure names and addresses are complete, correct, and legible.
  • Leaving information off the check or money order. Write your taxpayer identification number, “AMD-FAR,” and the correct tax year on it. Sign it and include it with the voucher.
  • Using a photocopied or resized voucher. Submit a high-quality printed original. Set printer page scaling to None and cut only on the dotted line.
  • Writing around the scanline. If the voucher has a scanline within its bottom 1½ inches, keep that area clear.

Questions people ask

When must the partnership payment election be filed and paid?

Section V states that the election under 7-1-13(G) NMSA 1978 must be filed and paid within 90 days of the Final Determination Date. The election excludes reasonably determinable adjustments that must be included in a direct or indirect corporate partner’s unitary business income, and adjustments resulting from an administrative adjustment request.

Who can act for the partnership when reporting federal adjustments?

The state partnership representative for the reviewed year has sole authority to act for the partnership. The partnership’s direct and indirect partners are bound by those actions.

What tax rate does Section V use?

Section V directs you to multiply the applicable adjustment amounts by 5.9% on lines 3, 6, 10, and 16. Add those lines to calculate total New Mexico tax due on line 17.

Can I attach a longer explanation of the changes?

Yes. Section III allows a separate sheet if needed. Include your SSN, ITIN, or FEIN on that sheet.
