RPD-41383: RPD-41383 2015 Sustainable Building Tax Credit Claim Form (Revision 2021-11)

New Mexico · New Mexico TRD · Used for tax years 2024, 2025, 2026

Form RPD-41383 is used to claim an approved New Mexico 2015 Sustainable Building Tax Credit on an income tax return. It reports the approved credit, amounts claimed in previous years, unused credit, and the amount applied to the attached return.

Who files this form

Use Form RPD-41383 if you hold an approved 2015 sustainable building tax credit and want to apply it to your New Mexico income tax.

Building owners must first obtain a certificate of eligibility from the Energy, Minerals and Natural Resources Department (EMNRD), then approval from the Taxation and Revenue Department (TRD). The credit is available after qualifying construction, installation, or renovation is complete.

A holder who receives an approved credit through a transfer may also claim it. TRD issues the new holder a transfer approval and a new credit number.

When it's due

The printed credit availability period covers tax years beginning on or after January 1, 2017, and ending on or before December 31, 2024.

This is a credit availability period, not a return-filing deadline. The text does not state a filing deadline for Form RPD-41383.

What you'll need

Have these documents and details ready:

  • Your TRD credit approval, Form RPD-41382, or your TRD-approved Form RPD-41384 if the credit was transferred to you.
  • Your EMNRD certificate of eligibility or approval form showing the first eligible tax year.
  • Your New Mexico income tax return: Form PIT-1, CIT-1, S-Corp, or FID-1, as applicable.
  • A completed Form RPD-41383, including Schedule A, and the Schedule CR for your return.
  • Records of credit amounts claimed in previous tax years.
  • The holder's name, mailing address, SSN or FEIN, and contact information.

The instructions require you to submit TRD approval with your income tax return.

How to file

  1. Enter the holder's identifying and contact information.
  2. On line 1, enter the beginning and ending dates of the tax year for the return claiming the credit.
  3. On line 2, enter net New Mexico income tax before subtracting any credits.
  4. Complete one Schedule A row for each approved credit. Include its credit number, first eligible tax year, approved amount, prior claims, unused amount, and amount applied to this return.
  5. Add Schedule A column (f) and enter the total on line 3. Line 3 cannot exceed line 2.
  6. Sign and date the form. Attach it, including Schedule A, to your income tax return with the applicable Schedule CR and TRD approval.
  7. Mail the claim with your return to the address printed on the New Mexico income tax return.

Common mistakes

  • Leaving out the signed claim form or Schedule CR. The form warns that failure to attach the signed form will result in denial of the credit. The applicable Schedule CR is also required.
  • Using carryforward credit before current-year credit. Apply credit approved for the current tax year first, then available carryforward credits, oldest approval first.
  • Claiming more than the tax due. Line 3 cannot exceed line 2. All credits from all sources together also cannot exceed net New Mexico income tax.
  • Listing unavailable credits on Schedule A. Do not include expired or unapproved credits, or credits that were not first claimed for the tax year in which they were approved to be applied.
  • Skipping the first eligible year's claim because no tax is due. The credit or eligible portion must first be claimed in that year before carryforward can be claimed, even if no tax is due.

Questions people ask

Can I carry unused credit forward?

Yes. Excess credit may be carried forward for up to seven years. You must first claim the credit or eligible portion in its eligible year, even if no tax is due.

How is the approved credit spread across tax years?

If the total approved amount for a tax year is less than $100,000, a maximum of $25,000 may be applied in the approval year and each of the next three tax years, as needed. If it is $100,000 or more, 25% of the total is applied in each of those four tax years. The amount used cannot exceed income tax due.

Can I sell or transfer unused carryforward after claiming the credit?

No. Once a holder or owner claims a credit, its carryforward may not be sold, exchanged, or transferred.

What if I am married and file separately?

If you could have filed a joint return, each spouse may claim only one-half of the credit that would have been allowed on a joint return.
