RPD-41321: RPD-41321 Biodiesel Blending Facility Tax Credit Claim Form (Revision 2021-09)

New Mexico · New Mexico TRD · Used for tax years 2024, 2025, 2026

Form RPD-41321 is used to claim an approved New Mexico biodiesel blending facility tax credit against gross receipts or compensating tax. It lists approved credits, amounts previously used, unused credit available, and the amount applied to the attached tax return.

Who files this form

Use Form RPD-41321 to claim a TRD-approved biodiesel blending facility tax credit against New Mexico gross receipts tax or compensating tax.

An eligible rack operator must:

  • Install equipment it owns to establish or expand a facility that produces blended biodiesel fuel.
  • Be registered with the Taxation and Revenue Department (TRD) and file Form RPD-41307, Rack Operator Report.
  • Obtain a dated certificate of eligibility from the Energy, Minerals and Natural Resources Department (EMNRD).
  • Obtain TRD approval of the credit before claiming it.

What you'll need

Have the following ready:

  • Your EMNRD certificate of eligibility and TRD approval on Form RPD-41339.
  • The tax return on which you are claiming the credit: Form TRD-41413, Gross Receipts Tax Return, or Form TRD-41412, Compensating Tax Return.
  • Schedule CR for the same report period.
  • Your business name, New Mexico Business Tax Identification Number (NMBTIN), contact name and phone number, and report period.
  • Each approved credit number, the approved amount, and the amount already applied to previous reports.

If you need more worksheet space, attach a separate schedule in the same format.

How to file

Before claiming the credit, apply to EMNRD for a certificate of eligibility. Submit that certificate and completed Form RPD-41339 to TRD for approval.

After approval:

  1. Complete Form RPD-41321 with your business information and the report period shown on the attached return.
  2. For each credit, subtract amounts previously used from the approved amount. Add the unused amounts from all worksheet pages and enter the total on line 1.
  3. On line 2, enter the amount you want to apply to the attached return. Apply older credits first, and do not exceed the gross receipts or compensating tax due.
  4. Submit the claim with the tax return and Schedule CR for that report period.

Electronic filing: Log in to Taxpayer Access Point (TAP). Follow the prompts to add Schedule CR and the required attachments to your gross receipts or compensating tax return.

By mail: Attach the claim form and Schedule CR to the tax return and mail them to the address printed on that return.

Common mistakes

  • Listing an unapproved or expired credit: Do not enter a credit that TRD has not approved or whose EMNRD certificate is more than four years older than the date of the request.
  • Using newer credits first: The form instructs you to apply older credits first.
  • Claiming more than the tax due: Line 2 cannot exceed the gross receipts or compensating tax due on the attached return.
  • Leaving supplemental pages out of the total: Line 1 must include column (d) amounts from every worksheet page.
  • Overlooking recapture: If you stop biodiesel blending without completing at least 180 days of facility availability within the first 365 days after the certificate is issued, you must notify TRD. Previously offset tax becomes due, and unused approved credit is canceled. The assessment must be paid within 425 days of the certificate's issuance.
