Common mistakes

  • Missing signatures or dates. Both the current holder and the new holder, or their authorized representatives, must sign and date the notice.
  • Leaving out the certificate. A copy of the EMNRD Certificate of Eligibility must be attached.
  • Mailing late. The notice must be mailed within 10 days of the sale, exchange, or other transfer.
  • Trying to transfer a used credit. Once the credit has been used, it cannot be transferred. Once a holder or owner claims the credit, the carryforward cannot be sold, exchanged, or transferred.
  • Splitting a transfer between taxpayers. A credit sold, exchanged, or transferred to another taxpayer must be transferred in full. For a partnership or other business association passing the credit to owners, each owner’s share must be proportional to their ownership interest, and the total cannot exceed the holder’s credit.
