New Mexico · New Mexico TRD · Used for tax years 2024, 2025, 2026
Form RPD-41238 is New Mexico’s application for the Rural Job Tax Credit. It summarizes qualifying jobs, eligible wages, and the credit requested by rural area tier, and includes certifications about the employer and jobs claimed.
Who files this form
An eligible employer files RPD-41238 annually to apply for the Rural Job Tax Credit for qualifying jobs created in rural New Mexico. Include all qualifying periods that ended during the calendar year claimed.
An eligible employer must qualify for in-plant training assistance under Section 21-19-7 NMSA 1978. A qualifying job must be a new job created after July 1, 2000, not created because of a change in the employer’s organizational structure, and occupied by an eligible employee for at least 44 weeks of a qualifying period.
When it's due
For the claimed calendar tax year, the printed deadline is December 31 of the following calendar year. The Department will deny an annual application filed after that deadline.
An eligible employer may apply once per calendar year. Every qualifying period included must have ended in the calendar year claimed.
What you'll need
Prepare:
- A completed and signed RPD-41238.
- RPD-41247, Rural Job Tax Credit Employee Eligibility Detail Report, as identified in the submission instructions.
- An email from the Economic Development Department confirming eligibility for the Job Training Incentive Program (JTIP) during all qualifying periods claimed.
- Form ACD-31102, Tax Information Authorization Tax Disclosure, if the contact person is not the taxpayer or an officer of the taxpayer, as directed in the instructions.
You will also need the employer’s FEIN, SSN or ITIN; New Mexico Business Tax Identification Number (NMBTIN); mailing and physical addresses; contact information; and job, wage and credit totals by tier area.
