335: Unit Concrete Products Tax Credit (2025)
New Jersey · NJ Division of Taxation · Used for tax years 2025
Form 335 calculates the Unit Concrete Products Tax Credit for the 2025 New Jersey Corporation Business Tax. It reports eligible purchases of concrete products that use carbon footprint-reducing technology, the allowable credit, and any credit carried forward.
Who files this form
Complete Form 335 if you are claiming the Unit Concrete Products Tax Credit on Form CBT-100, CBT-100U, or CBT-100S. You must also include the appropriate credit form in the year the credit was earned, even if you are not claiming the credit on that year's return.
To qualify, you must purchase certified unit concrete products that use carbon footprint-reducing technology, including permeable pavement:
- During the privilege period;
- For exclusive use in New Jersey to construct or improve a residential dwelling or commercial building, or to replace an impervious surface with permeable pavement; and
- In an amount of at least 100 square feet for each property.
You must have receipts verifying the purchases. For a combined return, the member that earned the credit must complete the form.
What you'll need
- Purchase receipts: Attach receipts verifying the eligible unit concrete product purchases to Form 335.
- Property details: Have the address and square footage of eligible products purchased for each residential or commercial property. Attach a rider if you need more space.
- Return figures: You will need the applicable tax liability, minimum tax, other credits already applied, and any credit carried forward from the previous year. Combined return members not sharing the credit also need the group and member allocation factors from Schedule J, line 9.
- Certification: Part V requires the signature of a duly authorized officer of the taxpayer and the date.
How to file
Include the completed Form 335 and purchase receipts with your Corporation Business Tax return. The supplied text does not provide a mailing address or e-file directions.
- Complete Part I. Both qualification answers must be “YES.” If either answer is “NO,” stop. You are not eligible for the credit.
- Complete Part II. Calculate the credit at $2 per square foot, limited to $3,000 per residential property and $30,000 per commercial property. Add any prior-year credit carryforward.
- Use the correct calculation section. CBT-100 and CBT-100S filers complete Part III. CBT-100U filers complete Part IV, Section A. Members not sharing their credit also complete Section B and fill in the nonsharing oval. All combined return filers must mark the combined return indicator.
- Report the allowable credit. Transfer line 12 to Schedule A-3, Part I of CBT-100 or CBT-100S. Combined return filers use the member's column of Schedule A-3, Part I of CBT-100U, transferring line 19 if sharing or line 26 if not sharing.
- Complete Part V. Certify that the products claimed are for exclusive use in New Jersey. This certification is required each tax year you claim the credit.
Common mistakes
- Using the same amounts to calculate this credit and another credit. This is not allowed.
- Including a property with fewer than 100 square feet of eligible products, or purchases made outside the privilege period.
- Exceeding the per-property credit limits of $3,000 for residential property or $30,000 for commercial property.
- Omitting purchase receipts or continuing after answering “NO” to either Part I question.
- Completing Part III for a combined return. Combined return filers must use Part IV instead.
- Skipping Part IV, Section A when a combined return member is not sharing the credit. Both Sections A and B are required in that case.
- Leaving out credits already applied to the relevant tax liability when calculating the allowable credit.
- Omitting the credit form in the year the credit was earned because no credit is being claimed that year.
Questions people ask
How much is the credit?
The credit is $2 per square foot of eligible products, up to $3,000 per residential property or $30,000 per commercial property. Each property must have at least 100 square feet of eligible products purchased.
Can unused credit be carried forward?
Yes. Excess credit can be carried forward for up to seven privilege periods.
Can the credit eliminate my minimum tax or offset the Corporate Transit Fee?
No. The credit cannot reduce tax liability below the statutory minimum tax and cannot be used against the Corporate Transit Fee.
Must a combined return member share its credit?
No. A member may choose not to share. It must indicate that choice in the oval at the top of the form and complete both Sections A and B of Part IV. Its credit is limited by both its share of the group's tax liability and the amount otherwise allowable against the group's tax liability.
