MI-4797: Adjustments of Gains and Losses From Sales of Business Property (2024)

Michigan · Michigan Treasury · Used for tax years 2024

Michigan Form MI-4797 adjusts gains and losses from sales of business property reported on U.S. Form 4797. It compares federal gains and losses with the amounts subject to Michigan income tax and is filed with Form MI-1040 or MI-1041.

Who files this form

Use 2024 MI-4797 only to adjust Michigan taxable income for capital gains or losses attributable to:

  • Sales of certain types of property located in other states and/or subject to Michigan’s allocation provisions.
  • Periods before October 1, 1967, under the Section 271 adjustment.

If you file U.S. Schedule D or Form 4797 and elect the Section 271 adjustment, you must file the equivalent Michigan forms, MI-1040D or MI-4797, and include all gains and losses realized during the tax year.

Do not use MI-4797 to apportion Michigan business income gains or losses. The form directs those amounts to MI-1040H or MI-461, if applicable.
