Common mistakes

  • Leaving out pages 2 or 3: The form says it cannot be processed unless both pages are completed and included.
  • Omitting Schedule NR: Checking nonresident estate or nonresident trust requires you to complete and include MI-1041 Schedule NR.
  • Completing line 23 on an original return: Line 23 is for 2024 amended returns only. Original returns should skip to line 24.
  • Leaving an amended return unexplained: Complete the Explanation of Changes section, show computations in detail, and include the amended U.S. Form 1041 and all supporting schedules.
  • Missing Schedule 4 when required: Complete it if capital gains or losses were distributed to beneficiaries and Form MI-1041D was filed. This applies to resident and nonresident estates and trusts.

Questions people ask

What tax rate does the 2024 form use?

Multiply taxable income on line 12 by 4.25% to calculate line 13. If line 12 is negative, enter zero on line 13.

Can an overpayment be applied to the next year?

Yes. Line 27 lets you apply part or all of the overpayment on line 26 to the 2025 fiduciary return. Subtract line 27 from line 26 to calculate the refund on line 28.

What if I need more room for beneficiary information or allocations?

Use the Michigan Fiduciary Income Tax Information Continuation Schedule, Form 5680, if additional space is needed for the schedules on page 3.

Can I authorize Treasury to discuss the return with my preparer?

Yes. Check the authorization box in the Signatures and Declarations section.

When should I complete Schedule 3?

Complete Schedule 3 only if adjustments were entered on Schedule 1. Schedule 1 directs you to carry the net Michigan adjustment to line 10 if there is no distribution to beneficiaries. Otherwise, complete Schedules 2 and 3.
