Michigan · Michigan Treasury · Used for tax years 2024

Form 4589 is the 2024 Michigan Business Tax Film Credit Assignment form used to assign or reassign Film Production and Film Infrastructure Credits. It records the project, assignor and assignee information, and the percentage and amount of credit assigned for Treasury approval.

Who files this form

Michigan Business Tax (MBT) filers use Form 4589 to assign all or part of a Film Production Credit or Film Infrastructure Credit to another taxpayer.

The taxpayer assigning the credit, called the assignor, must complete, sign, and file the form. A taxpayer who previously received an assigned credit also uses this form to reassign it.

Complete a separate Form 4589 for each project and each assignee, the taxpayer receiving the credit.

What you'll need

Gather the following information and attachments:

  • For an original Film Production Credit assignment: the Post-Production Certificate of Completion issued by the Michigan Film & Digital Media Office.
  • For an original Film Infrastructure Credit assignment: the Investment Expenditure Certificate issued by that office.
  • For a reassignment: a copy of the approved immediately preceding assignment form.
  • Assignor information: name, address, FEIN or Treasury-assigned TR number, project number, and tax year-end date.
  • Assignee information: name, FEIN or TR number, tax year-end date, and percentage of the credit being assigned.

Treasury will return the approved form to the assignor with an authorized Treasury signature. Give each assignee a copy to file with their MBT return and any required attachments. A taxpayer retaining part of the credit must submit the same information.

The assignee reports the assigned Film Production Credit on Form 4574, MBT Refundable Credits, or the assigned Film Infrastructure Credit on Form 4573, MBT Miscellaneous Nonrefundable Credits.

Common mistakes

  • Leaving the form unsigned. The assignor must sign it for it to be valid.
  • Missing the required attachment. Attach the applicable certificate for an original assignment or a copy of the approved immediately preceding assignment form for a reassignment.
  • Combining projects or assignees on one form. A separate Form 4589 is required for each project and each assignee.
  • Using the wrong date format. Enter dates as MM-DD-YYYY.
  • Failing to provide the approved form to the assignee. Each assignee must receive a copy to file with their MBT return and required attachments.
