Common mistakes

  • Submitting an incomplete or unsigned affidavit. The form must be completed in full and have original signatures from all three required parties. Failure to submit a fully completed and signed affidavit results in disallowance of the credit related to that loan-out company.
  • Leaving out page 2. The form specifically reminds filers to complete it.
  • Not filing the affidavit with the credit application. The completed form must accompany the Application for Payroll/Production Credit.
  • Overlooking registration requirements. If either loan-out company registration indicator is not filled in, the form says the company must register with the Massachusetts Secretary of State and DOR. If the actor’s or performer’s DOR registration indicator is not filled in, they must register with DOR and file a personal tax return.
  • Not retaining signed copies. The loan-out company and actor or performer should keep copies for their records and attach them to their Massachusetts income tax returns as required.
