Who files this form

Use Form N-330 to claim Hawaii’s credit for school repair and maintenance. The form covers certified contributions of in-kind services and credits received through other entities.

It also provides for carrying forward unused credit from a prior year. The form does not state that all taxpayers must file it.

What you'll need

Depending on the credit you are claiming, the form calls for:

  • Your name as shown on your tax return and your SSN or FEIN.
  • The Department of Education certificate on Form N-330 for contributed in-kind services. The Department of Education completes this section, including the contribution’s value and date, contractor licensing information, tax clearance certificate status, and certification signature.
  • Schedule K-1 from Form N-20, N-35, or N-40, or federal Form 1099-PATR, if you receive a credit through another entity. You also enter the entity’s name and federal employer identification number.
  • Your prior-year unused credit amount, if any, and your adjusted income tax liability from the applicable return.
  • Schedule CR to report the new credit, credit applied, and unused carryover, as applicable.

If you claim other nonrefundable credits, line 16 calls for the credit worksheet in the instructions. Those instructions are not included in the supplied text.

How to file

Attach Form N-330 to Form F-1, N-11, N-15, N-20, N-30, N-35, N-40, or N-70NP, as applicable. The supplied form does not give a mailing address or e-file directions.

For the taxpayer computation:

  1. On line 9, enter the certified value from line 4 or $40,000, whichever is less. Multiply that amount by 10% on line 10.
  2. Enter any credit received through another entity on line 11. Add lines 10 and 11 on line 12 and report that amount in Schedule CR, column (b), on the appropriate line.
  3. Unless the form directs you to skip the remaining lines, add any prior-year carryover and complete the tax liability calculation.
  4. Report the credit applied from line 18 in Schedule CR, column (c). If line 19 shows unused credit greater than zero, report it in column (d).

Form N-20 and N-35 filers report line 12 on the appropriate lines of their Schedule K and skip lines 13 through 19. The form directs N-40 filers to consult the instructions, which were not supplied.

Common mistakes

  • Completing lines 9 and 10 when the pass-through-only note applies. If you are only claiming a distributive share from a partnership, S corporation, estate, or trust, skip those lines and begin on line 11.
  • Completing lines 13 through 19 as a Form N-20 or N-35 filer. The form tells these filers to skip those lines and report line 12 on the appropriate Schedule K lines.
  • Forgetting the attachment. Form N-330 must be attached to one of the tax returns listed at the top of the form.

Line 18 uses the smaller of your tentative current-year credit on line 14 or your remaining tax liability on line 17.
