Colorado · Colorado DOR · Used for tax years 2025

Colorado Form DR 1370 is a schedule for claiming certified Enterprise Zone or CHIPS Zone tax credits when a taxpayer has a refund certificate from the Office of Economic Development and International Trade (OEDIT). It reports available credits, amounts applied against tax, and am

Who files this form

Use the 2025 DR 1370 to claim OEDIT-certified Enterprise Zone or CHIPS Zone credits when you have been issued a refund certificate. Submit it with your return to claim refundable credits earned after the certificate was issued.

Any partnership or S corporation that received an OEDIT refund certificate for these credits must complete DR 1370. Partners and shareholders complete their own DR 1370 to claim credits passed through on DR 0106K.

If you received a credit certificate for CHIPS Zone activity but no refund certificate, use DR 1366 for Enterprise Zone credits or the corresponding credit schedule for the Job Growth Incentive tax credit instead.

What you'll need

  • Credit certifications: Submit copies of certification forms generated by the EZ Tax Credit online system and the credit certificates supporting each credit claimed.
  • Refund certificate information: Have your OEDIT refund certificate balance available when choosing credits to claim as a refund.
  • Identification: Provide your name or business name and Social Security number, ITIN, FEIN, or Colorado Account Number. For passed-through credits, also provide the partnership’s or S corporation’s FEIN or Colorado Account Number.
  • Pass-through credit information: Use your DR 0106K if claiming a partner’s or shareholder’s share of credits.
  • Prior-year information: Have your 2024 DR 1370 available if including unused eligible 2024 credits or completing Worksheet 4.
  • Credit calculations: Depending on the credit, you may need investment amounts, employee counts, qualified rehabilitation expenditures, or research expenditures for the current and two preceding years.

Keep the worksheets for your records. Do not send them.

How to file

  1. Complete the parts of DR 1370 that apply to your credits. Use the worksheets where directed.
  2. Enter available credits in Column A, credits applied against current-year tax in Column B, and credits drawn against your refund certificate in Column C.
  3. Total the credits in Part VI. Transfer lines 21, 22, and 24 to the applicable return or credit schedule as directed on the form.
  4. Submit DR 1370 and copies of the required credit certifications with your tax return.

Taxpayers claiming Enterprise Zone or CHIPS Zone credits are required to file electronically. Revenue Online can be used to file the return and attachments electronically.

If you cannot file electronically, include DR 1370 and supporting documentation with your paper return. The Department strongly recommends electronic filing and warns that not filing electronically may delay processing.

Common mistakes

  • Using current-year credits before carryforwards: Use current-year credits only after all carryforward credit has been exhausted. Use DR 1366 for Enterprise Zone credits carried forward from years before the refund certificate was issued.
  • Combining investment categories on line 7: Report renewable energy investments on line 8, commercial vehicle investments on line 9, and job training investments on line 10, not line 7.
  • Missing credit certificates: Submit copies of the certificates supporting each credit claimed.
  • Sending worksheets: The worksheets say to keep them for your records, not send them.
  • Claiming a rehabilitation credit refund: The Vacant Commercial Building Rehabilitation Credit cannot be refunded and is available only in Enterprise Zones, not CHIPS zones.
  • Reporting Job Growth Incentive credits on other credit lines: If you have a refund certificate, Part V says to use only DR 1370, not line 46 of DR 0104CR, line 13 of DR 0105 Schedule G, line 9 of DR 0106CR, or line 13 of DR 0112CR.

Questions people ask

Will I receive the full amount drawn against my refund certificate?

No. The credit claimed as a refund is reduced by 20%. Line 23 records the amount deducted from your credit certificate and refund certificate balances. Line 24 multiplies that amount by 80% to calculate the allowable refund.

Can I include unused credits from 2024?

Yes. The instructions direct you to include eligible credits earned during tax year 2024 after OEDIT issued your refund certificate that you did not use in 2024. Follow the calculation for each applicable line using your 2024 DR 1370.

What limits apply to investment credits used against tax?

The amount is limited to the smallest of your net tax liability, $5,000 plus 50% of net tax liability above $5,000, or $750,000. The $750,000 limit also applies to the combined investment credit applied against tax and claimed as a refund. That limit does not apply to credits carried forward from a tax year before 2014.

How do partnerships and S corporations allocate credits?

They calculate credits available to all partners or shareholders, including residents and nonresidents. A composite nonresident return may use included members’ shares up to their tax amount, subject to additional limits. Credits not applied against tax on that return must be allocated on DR 0106K.
