541: California Fiduciary Income Tax Return (2024)

California · FTB · Used for tax years 2024

California Form 541 is the Fiduciary Income Tax Return for estates and trusts for 2024. It reports income, deductions, credits, taxes, and payments to calculate tax due or a refund, and includes schedules for charitable deductions, income distributions, and California income appo

What you'll need

Have the estate or trust’s name, federal employer identification number (FEIN), fiduciary names and titles, and address ready. The form also asks for the date the trust was created or the date of the decedent’s death.

Depending on what you report, the form calls for these attachments:

  • Business income or loss: federal Schedule C (Form 1040).
  • Capital gain or loss: Schedule D (541).
  • Rental, royalty, partnership, or other estate and trust income: federal Schedule E (Form 1040).
  • Farm income or loss: federal Schedule F (Form 1040).
  • Ordinary gain or loss: Schedule D-1.
  • Other deductions not subject to the 2% floor: a supporting schedule.
  • Income distribution deduction: Schedule K-1 (541).
  • Credits on line 23: a worksheet.
  • Alternative minimum tax: Schedule P (541).

If the estate or trust received tax-exempt income, attach a computation showing the allocation of expenses. If the return includes a Reportable Transaction or Listed Transaction, complete and attach federal Form 8886.

Common mistakes

  • Completing Schedule A for the wrong entity. The form says not to complete this charitable deduction schedule for a simple trust or pooled income fund.
  • Skipping Schedule G when it is required. Complete it if the trust has nonresident trustees and/or nonresident beneficiaries. Complete lines 1a through 1f before Part II.
  • Missing the final-year income reminder. For an estate, the form notes that income of the final year is taxable to beneficiaries.
  • Omitting required attachments. The form specifically requires an expense-allocation computation when tax-exempt income was received, and federal Form 8886 when a Reportable Transaction or Listed Transaction is included.
